Safety Recommendations

 

Foreword

At any stage of the investigation of an accident or incident, the accident or incident investigation authority of the State conducting the investigation shall recommend to the appropriate authorities, including those in other States, any preventive action that it considers necessary to be taken promptly to enhance aviation safety.(International Standards and Recommended Practices – Annex 13 to the Convention on International Civil Aviation – Chapter 6.8) Within this framework, the BEA can be required to issue recommendations before the publication of the report. These recommendations are included in this section until their inclusion in a report.

In accordance with Annex 13 to the Convention on International Civil Aviation, European Directive 94/56/CE and the French Civil Aviation Code (Book VII), the investigation into an accident or incident is intended neither to apportion blame, nor to assess individual or collective responsibility. The sole objective is to draw lessons from this occurrence which may help to prevent future accidents or incidents. In accordance with European Directive 94/56/CE, a safety recommendation shall in no case create a presumption of blame or liability for an accident or incident. Consequently, the use of a report or recommendation for any purpose other than for the prevention of future accidents could lead to erroneous interpretations.
